What Zoe Is NOT:

❌ Medical or mental health treatment
❌ Crisis intervention service
❌ Substitute for licensed professionals

For Emergencies:

🆘 Call 988 (US Crisis Lifeline) or your local emergency services
Do NOT rely on Zoe for crisis situations

Requirements:

✓ Must be 18 or older
✓ AI may make errors - use your judgment
✓ You're responsible for your decisions
✓ Data processed by OpenAI (see Privacy Policy)

1. WHAT ZOE IS (AND ISN'T)

Zoe Is:

A wellness tool using AI to provide relationship guidance, emotional support, and personal growth coaching.

Zoe Is NOT:

NOT therapy - Not a licensed therapist, psychologist, psychiatrist, or counselor
NOT medical care - Not a healthcare provider or medical service
NOT for emergencies - Cannot handle crisis situations
NOT confidential - Conversations lack legal therapist-client privilege

When to Seek Professional Help:

See a licensed professional if you experience:

Depression, anxiety, or mental health symptoms
Suicidal thoughts or self-harm urges
Relationship abuse or violence
Trauma or severe distress
Any condition requiring professional diagnosis/treatment

Zoe complements professional care but cannot replace it.

2. USING ZOE

Who Can Use Zoe:

✓ Adults 18 years or older
✓ Individuals seeking wellness support
✓ Users who understand AI limitations

Who Cannot Use Zoe:

❌ Anyone under 18 (no exceptions)
❌ Those seeking professional therapy/medical care
❌ Those in crisis or emergency situations

License to Use:

We grant you a limited, personal, non-transferable license to use Zoe on your Apple devices for personal, non-commercial use only.

You may NOT:

Sell, rent, or share access to Zoe
Reverse engineer or copy the software
Use Zoe for commercial purposes
Remove copyright notices
Extract or scrape data

Your Responsibilities:

✓ Provide accurate information
✓ Keep your password secure
✓ Use Zoe responsibly and lawfully
✓ Respect others' privacy
✓ Make your own informed decisions

3. PROHIBITED ACTIVITIES

You May NOT:

❌ Use Zoe for illegal purposes
❌ Harass, threaten, or harm others
❌ Share harmful, hateful, or abusive content
❌ Attempt to hack or compromise security
❌ Use bots, scripts, or automated access
❌ Violate OpenAI's Terms of Service
❌ Impersonate others or provide false information
❌ Use Zoe to replace necessary professional care
❌ Attempt to manipulate or exploit the AI
❌ Interfere with other users or our operations

Violations result in immediate account termination and possible legal action.

4. YOUR CONTENT & DATA

You Own Your Content:

You retain ownership of your conversations, relationship profiles, and personal information.

License You Give Us:

By using Zoe, you grant us permission to:

✓ Store and process your content to provide the service
✓ Share your content with OpenAI for AI processing
✓ Use anonymized data for service improvement
✓ Back up your content for data recovery

What We Don't Do:

❌ Claim ownership of your conversations
❌ Share your identifiable content publicly
❌ Use your data for advertising
❌ Sell your personal information

Data Sharing:

Your conversations are shared with OpenAI to power Zoe's AI. See our Privacy Policy for complete details on data processing.

5. AI LIMITATIONS

AI Technology Used:

Zoe uses OpenAI's artificial intelligence to generate responses. This means:

AI May:

❌ Make errors or provide inaccurate information
❌ Misunderstand context or complex situations
❌ Give inappropriate or unhelpful advice
❌ Fail to recognize crisis situations
❌ Hallucinate facts or make assumptions

AI Cannot:

❌ Replace human professional judgment
❌ Provide medical or psychiatric advice
❌ Guarantee any specific outcomes
❌ Understand nuances like human therapists
❌ Be held professionally liable

Your Responsibility:

YOU are solely responsible for:

Evaluating whether AI responses are appropriate
Making your own decisions about relationships
Seeking professional help when needed
Not relying exclusively on AI for important choices

WE ARE NOT LIABLE FOR:

Decisions you make based on AI responses
Relationship outcomes
AI errors or inappropriate suggestions

OpenAI Compliance:

You agree not to use Zoe in ways that violate OpenAI's Terms of Service or Acceptable Use Policy.

6. SUBSCRIPTIONS & PAYMENTS

Pricing:

Free trial: 3 days (if offered - cancel before trial ends to avoid charges)
Monthly: $9.99/month
Annual: $59.99/year
Prices may change (current subscribers protected until renewal)

Payment Processing:

All payments through Apple In-App Purchase
Managed through your Apple ID
We don't receive your payment card details
Apple's terms and refund policies apply

Auto-Renewal:

Subscriptions renew automatically unless canceled
Cancel anytime through iPhone Settings > Subscriptions
Access continues until end of current billing period
No refunds for partial periods (except as required by law)

Refunds:

Handled by Apple (not by us directly)
Request through App Store or reportaproblem.apple.com
Generally 14-day window per Apple's policy
We may issue refunds in exceptional cases at our discretion

No Guarantee:

Subscribing does NOT guarantee relationship improvements, specific outcomes, or results.

7. ACCOUNT TERMINATION

You Can Terminate:

Cancel subscription through Apple
Delete account via app Settings
Uninstall the app
Email connect@sonealabs.com

We Can Terminate:

We may suspend or terminate your account immediately if:

You violate these Terms
You engage in prohibited activities
You provide false information
We suspect fraud or illegal activity
Required by law
We discontinue the service

After Termination:

Access ceases immediately
Subscription not refunded (unless required by law)
Data deleted per Privacy Policy (within 30 days)
Some provisions survive (disclaimers, liability limits, dispute resolution)

8. DISCLAIMERS

"AS IS" Service

ZOE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES.

WE DO NOT WARRANT:

❌ Accuracy or helpfulness of AI responses
❌ Improvement in your relationships
❌ Uninterrupted or error-free service
❌ Compatibility with your device
❌ That Zoe will meet your expectations
❌ Security against all threats

No Professional Advice

WE SPECIFICALLY DISCLAIM:

Any warranty that Zoe provides professional therapy
Any warranty of fitness for medical/therapeutic purposes
Any warranty that AI can replace human professionals

Third-Party Services

WE ARE NOT RESPONSIBLE FOR:

OpenAI's service performance or availability
Apple's payment processing
Third-party service failures

Some jurisdictions don't allow disclaimer of implied warranties. If this applies to you, some disclaimers may not apply.

9. LIMITATIONS OF LIABILITY

Maximum Liability Cap

OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED:

The amount you paid us in the past 12 months, OR
$100 USD,
WHICHEVER IS LESS

What We're NOT Liable For:

WE ARE NOT LIABLE FOR:

Personal:

Emotional distress or psychological harm
Relationship problems, breakups, or conflicts
Personal injury
Decisions made based on Zoe's guidance

Financial:

Lost profits or business opportunities
Any indirect or consequential damages

Technical:

Data loss or corruption
Service interruptions or downtime
AI errors or inappropriate responses
Security breaches by third parties

Third-Party:

OpenAI service failures
Apple payment issues
Actions of other users

THESE LIMITATIONS APPLY EVEN IF:

We were negligent (but not grossly negligent)
We were advised damages were possible
A remedy fails its essential purpose

Some states don't allow limitation of liability. If this applies to you, some limitations may not apply.

10. DISPUTE RESOLUTION

Try to Resolve Informally First:

Before filing any claim, contact us at connect@sonealabs.com. We'll attempt to resolve disputes informally for 30 days.

Binding Arbitration:

IF WE CAN'T RESOLVE INFORMALLY:

All disputes go to binding arbitration (NOT court)
Conducted by American Arbitration Association (AAA)
Virtual/telephonic arbitration
Each party pays own costs (arbitrator fees split for consumers)
Arbitrator's decision is final and binding

Class Action Waiver:

YOU WAIVE YOUR RIGHT TO:

Participate in class action lawsuits
Join with other users in consolidated proceedings
Bring representative actions on behalf of others

Arbitration is individual only.

Opt-Out:

You may opt out of arbitration within 30 days of accepting these Terms by emailing connect@sonealabs.com with "Arbitration Opt-Out" in the subject.

Exceptions:

Small claims court and intellectual property disputes are NOT subject to arbitration.

11. GENERAL TERMS

Changes to Terms:

We may update these Terms anytime
Material changes = email notice + in-app notification
Continued use = acceptance of changes

Service Changes:

We may modify or discontinue features anytime
No obligation to maintain specific features
Not liable for service changes or interruptions

Assignment:

You cannot transfer these Terms or your account
We may assign to successors or in business transfers

Severability:

If any provision is invalid, others remain in effect
Invalid provisions modified to be enforceable

No Waiver:

Our failure to enforce doesn't waive our rights

Entire Agreement:

These Terms + Privacy Policy = complete agreement
Supersedes prior agreements or understandings

✓ I am responsible for my own decisions and actions
✓ I consent to data processing by OpenAI per the Privacy Policy
✓ I agree to arbitration and waive class action rights
✓ I will seek professional help for serious concerns
✓ I have read and accept these Terms of Use

If you do NOT agree, you must NOT use Zoe.
